Definition
The 2016 United States regulation, effective in August of that year, that extended the Food and Drug Administration's tobacco authority to cigars, pipe tobacco, and vapor products. In 2023 a federal district court vacated the rule as applied to premium cigars, a decision upheld on appeal, and subsequent orders have addressed how premium cigars are defined for that exemption.
Why it matters
The rule and the litigation over it have determined for a decade what new premium cigars could legally be introduced in the United States, and the exemption remains a live regulatory question.
