Definition
The FDA pathway by which a tobacco product introduced after the statutory predicate date of February 15, 2007 may be marketed if it is shown to be substantially equivalent to a product on the market on that date.
Why it matters
For cigars the process was slow and expensive enough to discourage new blends outright, which is why the premium exemption litigation mattered so much to small manufacturers.
